  1. Visual Classworks Shareware Version 4

  3. END USER LICENSE AGREEMENT

  5. This is an agreement between Step Ahead Software Pty Limited
  6. (to be hereinafter referred to as "Step Ahead Software") and
  7. you, the end user, of one licensed copy of the software program,
  8. Visual Classworks.
  9.  
  10. COPYRIGHT
  11.  
  12. The software program "Visual Classworks" and any accompanying written
  13. materials (to be hereinafter collectively referred to as the "Software"),
  14. is and shall remain the property of Step Ahead Software. In addition and
  15. without any limitation to the foregoing the rights to reproduce, multiply
  16. and make copies of the Software is an shall remain the exclusive property
  17. of Step Ahead Software except as otherwise provided for in this agreement.
  18. The Software is protected by all applicable copyright laws and
  19. international treaties.

  21. LICENSE

  23. The rights granted to you under this license will cease from 30 days after the
  24. day on which you first received this shareware product. After that period you 
  25. can upgrade from a previous version if you are a registered user of a previous
  26. version or you can register the shareware or you can purchase the professional
  27. version. As a reward for registering (See pricing and ordering information in
  28. the help file) your shareware version the limit of 12 classes and 12 data and 
  29. 12 function members will be doubled to 24 in a version that will be shipped to you.

  31. Step Ahead Software grants you the right to use the Software on a single
  32. computer for a period of 30 days from the day you first received it. After this
  33. you must register the software. If the Software is to be used on a network by 
  34. more than one user at any time then more registered copies of the Software must 
  35. be purchased. One registered copy must be purchased for each computer on which 
  36. the software is to be used.

  38. You may redistribute the complete distribution file unchanged but you must not
  39. charge for it except for a reasonable charge for any media that it is supplied
  40. on. The distribution file may be uploaded and stored on BBS, Web Sites etc., 
  41. indefinitely.

  43. Educational institutions must contact Step Ahead Software directly for the use
  44. of Visual Classworks as a teaching tool. Terms are very favourable to educational
  45. institutions.
  46.  
  47. You must not rent or lease the Software.
  48.  
  49. You will remain solely responsible to anyone receiving a program made by
  50. you which includes any code generated by using this Software. You will
  51. indemnify and hold Step Ahead Software and its suppliers harmless from
  52. and against any claims or liabilities arising out of the use,
  53. reproduction or distribution of the program.
  54.  
  55. You will not disassemble or reverse compile or reverse engineer the
  56. Software or any portion of the Software.
  57.  
  58. This program is provided "as is" without warranty of any kind, either
  59. expressed or implied, including but not limited to implied warranties of
  60. merchantability and fitness for a particular purpose.
  61.  
  62. In no event will Step Ahead Software be liable to you for any damages,
  63. including, but not limited to, any lost profits, lost savings, or any
  64. other incidental or consequential damages arising out of the use or
  65. inability to use this program, even if Step Ahead Software has been advised
  66. of such damages, or for any other claim by any other party.

  68. Step Ahead Software does not warrant that Visual Classworks supports or
  69. utilises every feature of the C++ language or that the import feature will
  70. import all possible C++ constructs. The sole risk in determining whether
  71. or not Visual Classworks is appropriate for your use lies with you.

  73. If for any reason any portions of this agreement are not enforceable or
  74. unlawful then all other remaining portions will still form a valid
  75. license agreement.

  77. U.S. Government restricted rights: Use, duplication, or disclosure by
  78. the Government is subject to restrictions as set forth in subdivision
  79. (b)(3)(ii) of the Rights in Technical Data and Computer Software Clauses
  80. at 252.227-7013.
